荀子法伦理思想及现代启示

荀子的法伦理思想对当今法治建设至少具有以下启示:第一,治国安邦,法律必不可少;第二,治国安邦决不能唯法是用,而是必须优先重视道德文化建设;第三,理想的法律必须是仁爱、公平精神的象征,否则,法律自身的合法性就应受到质疑,其对社会成员的约束力也将大打折扣;第四,法律必须遵循功赏相当、罪罚相应、奖惩分明的公正原则;第五,统治者必须首先遵纪守法,才能保证法律的顺利实施;第六,荀子主张以法律手段禁绝儒家以外的其他学说,以此实现思想统一,这一文化专制的法伦理思维模式必须为当今法治建设摒弃。
