| 摘 要： | 律师在场权的立法缺失问题,随着今年五部委＂非法证据排除规则＂的出台,再次成为了热议的焦点。针对该问题,在分析了律师在场权立法缺失的原因,论证了该权利立法必要性的基础上,提出了律师在场权的制度设计。在宏观的层面,重点论证了律师在场权的适用范围、程序和基本内容。
