| 摘 要： | 目前,非法证据排除规则已成为世界各国通行的刑事诉讼的采证规则之一,但由于多方面因素的影响,我国对于非法证据排除规则在立法上并没有明确规定,非法证据排除规则在我国的确立也面临重重困难。但是,根据国际刑事司法发展的趋势,以及现代法治的渴求,在我国确立非法证据排除规则是势在必行的事。

| Abstract: | At present, the illegal evidence removesing ing the rule has become one of general criminal prosecution lottery ticket rules in the world, but as a result of the various factor influence, our country has not explicitly stipulated in the legislation. It also faces a lot of difficulty. But, according to the international criminal judicature development tendency, as well as the expectation of modem legal ruling to establishe. the illegal evidence to remove the rule is the imperative matter. |
