| 摘 要： | 刑罚轻缓化是当今世界刑法发展的主流，它不但能够有效地遏制犯罪，而且在争取罪犯改过自新，重新回归社会方面起到了积极的作用。研究刑罚轻缓化问题对于有效预防犯罪具有重要的理论指导意义。
