| 摘 要： | 对于同一法律问题,不同学者亦会从不同的角度进行不同的阐述,可谓是见仁见智。笔者认为,人们之所以热衷于在死刑存废问题上展开激烈的争论,究其本源还是因为对“刑罚的人性基础”存在不同的认识。
