高校体育商业化过程中的学生运动员报酬问题——基于《谢尔曼法》的考察

学生运动员的报酬问题是我国高校体育商业化过程中不可回避的一个问题，对这个问题的回答可借鉴美国经验。近年来，美国学校体育中的学生运动员报酬给付规则遇到了很大的法律挑战，美国法院的判决结果不仅会影响学生运动员的经济权益、法律地位，还可能会给美国高校体育管理结构造成颠覆性的影响。采用文献资料调研、对比分析、逻辑分析、例证等方法，对美国学校体育中的学生运动员报酬给付规则是否违反《谢尔曼法》进行探讨，并在此基础上对是否应向学生运动员支付薪酬等问题进行论证，提出我国在发展高校体育过程中应当重视商业化和业余化的平衡，合理利用法律来保护学生运动员的权益。

Anti-trust Review of Amateurism Rules in College Sports: Based on Examination of Sherman Act

The reward of student athletes is an unavoidable factor in the development of the commercialism of college sports in China. The American experiences are worth drawing from. In the recent years, the student athlete reward rules have met many judicial challenges. The decision of court has not only impacts on the interest and legal status of the student athletes, and has revolution impacts on the management structure of college sports. This paper, adopting literature review, comparative analysis and logic analysis, discusses whether the student athletes reward rules in the college sports violating the Sherman Act. Hereafter, it illustrates the issue of whether it should pay to student athletes. It proposes that there should be a balance between commercialism and amateurism, the law should be used to protect the right of the student athletes.
