| 摘 要： | 在生物技术等新科技的研究成果中科学发现和技术发明的界限逐渐趋于模糊.一些自然物质被授予专利权引起专利法中发明与发现的争论.本文从多个方面分析了发明和发现区分模糊的原因在于科学技术的发展引起的变化,并提出以新颖性、创造性尤其是较严格的实用性作为当前生物技术研究成果可专利性的标准.

| Abstract: | On biotechnology study, the difference between the discovery and invention is becoming indistinct. Some nature substance was patented, which leads to a dispute. The points out analysis that the reason of the indistinctness between them is the change of the science and technology 's development and it also poiuts out the novelty, inventive and especially utility as the criterion of patenting subject substance on biotechnology. |
