| 摘 要： | 《消费者权益保护法》第49条是目前我国唯一的有关惩罚性赔偿条款。针对我国消费者雏权意识的不断增强，从我国现状出发，制定的——惩罚性赔偿条款(第49条)具有一定的实用价值和现实意义。
