| 摘 要： | 公有公共设施致害后无法通过正常的法律途径获得国家赔偿是当前国家赔偿中存在的不可忽视的问题.这一问题应得到足够的重视,因为将公有公共设施致害纳入国家赔偿是十分必要的.但在构建该制度时应注意到公有公共设施致害纳入国家赔偿的范围和归责原则两个方面的问题.

| Abstract: | Those injurefl, by the public infrastructure usually cannot get state indemnity through legal procedure, which should arouse attention. It is imperative to include injuries by the public infrastructure in the state indemnity. On the other hand, we should pay attention to the problems of categorization and imputation principle when we set up the policy. |
