| 摘 要： | 南京换妻一案引出社会的诸多争论,该案件的庭审,更是让各界人士展开了关于是否取消聚众淫乱罪的激烈讨论。换妻究竟是达到了对个人性权利自由的表达,还是剥夺了个人的性自由权?是犯罪还是违反社会风俗?是对婚姻关系的亵渎还是维护?文章通过对事件进行价值观的分析和讨论,对人的自由进行解读,期望得出事件中深层的价值观根源,最后提出相应的价值修正方法。

| Abstract: | The case of wife-swapping in Nanjing leaded many social arguments.The trial of the case which caused the public to make an intensive discussion about whether to cancel the mob adultery.Is wife-swapping achieve the rights of individual freedom of expression,or deprived of personal liberty? Is it a crime or violation of social customs? Is it a desecration of marriage or maintenance? The article explains the human liberaty basing on the analysis and discussion of values displayed in the incident.It is expected to find out the values rooted in the incident.Finally,we can apply a correction method to corresponding value. |
