| 摘 要： | 独立担保自上世纪中后期广泛应用,国外也有判例和学理上的普遍认可。独立担保较传统担保有许多优势,在我国担保业务实践中也日显重要,但是其国内法律地位不明确,不利于保护国内当事人。因此,应该对我国目前的独立担保法律进行完善。

| Abstract: | Independent guarantee has been used extensively since middle to late part of the 20~(th) century.It is approved in both cases and periodicals abroad.Compared with traditional guarantee,independent guarantee has more superiority and plays more and more important role in the professional practice of China.However,the legal position of independent guarantee leaves much room to be desired for protecting the interests of clients in China.Therefore,it is quite necessary to improve the present law on independent guarantee. |
