| 摘 要： | 经济全球化压力下，国家与市场日益分离，造成现代民族国家治理结构的衰落，福利国家面临解体，而目前尚未出现其功能上的替代物。面对民主国家治理结构的尴尬，哈贝马斯认为民族国家已转变为“后民族国家结构”，这种治理结构从全球化的市场中孕育出政治治理的合法形式，为福利国家解体后资本主义与民主之间的张力找到缓冲点，其中欧盟的形式就是其典范。

| Abstract: | Under the pressure of economical globalization, markets have gradually separated from the state, which causes the depression of modern nation-state's government structure, and the destruction of welfare state, however, nowadays there's no it's functional substitute. Facing the embarrassment phenomenon, Habermas claims that the nation-state has been transformed into post nation-state, which structure can obtain new legitimative formation from global market, and find the equilibrium between the capitalism and democracy .The European Union (EU) is a typical sample. |
