中国专利权质押制度存在的问题及其完善

研究中国现行专利权质押担保制度存在的妨碍专利权质押担保功能实现的关键问题：限制出质专利权的许可实施、转让，质权人对出质专利权的实施、许可实施、转让情况缺乏知情权，质权人对基于实施、许可实施、转让产生的收益缺乏相应的控制权．在此基础上，提出了解决问题的思路和具体措施：赋予出质人对出质专利权享有转让、实施、许可实施的权利，赋予质权人对出质专利权的实施、许可实施、转让享有知情权并对因此产生的收益享有一定程度的控制权．通过上述政策调整，将进一步完善我国鼓励企业技术创新的知识产权信用担保制度．

Existing Problems of the Patent Pledge System and the Improvements

It studies the key issues of the function failure of the patent pledge guarantees,which is caused by the current system of the patent pledge guarantees,such as,restrictions on the licensed implementation and transfer of the pledged patent,deprivation of the right to know the conditions of the implementation,the licensed implementation and transfer of the pledged patent from the pledgees,the pledgees lacking the corresponding control of the revenue generated by the implementation,the licensed implementation and transfer of the pledged patent and so on.Accordingly,ideas and specific measures are put forward to solve these problems,for instance,the pledgors are endowed with the rights to transfer,implement,licensedly implement the pledged patent,while the pledgees with the rights to know the transfer,implementation and licensed implementation,and to some extent,to control the resulting benefits.These policy adjustments will further improve the country's credit guarantee system of intellectual property rights to encourage enterprises' technology innovations.
