工资集体协商制度推进中的问题与解决路径

摘    要:工资集体协商体现了劳动关系双方相对平等的博弈地位,通过双方谈判、协商,形成合理、适当的工资协议,有利于形成稳定、和谐的社会主义劳动关系。在劳动合同法颁布实施后,我国在立法上已经初步形成了对劳动集体协议的制度保障。现阶段,我国工资集体协商制度的推进尚处于初始阶段,阻力很多,存在形式主义色彩,造成了劳动分配中的一些矛盾。为推进我国工资集体协商制度的发展,加强工会组织的独立性,转变用人单位的观念,调整地方政府、劳动行政部门的工作态度。

Abstract:Collective negotiation system of wages reflects a relatively equal status of both sides of labor relationship,and it is helpful to the two parties to form a stable and harmonious labor relations and make a reasonable and appropriate wages agreement through negotiation.With the promulgation and implementation of Labor Contract Law,China has initially formed the legislation protection on collective wages negotiations.However,at present,as it is still in the initial stage,the system faces resistance and remains in the form.And the formalism has caused some conflict.To improve the system,the labor unions should be strengthened and become independent,the employment conception should be changed,and the service functions of local governments should be improved.
