| 摘 要： | 国内法学界关于推动国际法演进之因素的主导学说是“共同意志”说,该学说注重于主观层面的依据而忽视客观层面的依据.而“国家战略互动”体现了主客观因素的结合,是比较科学的解释国际法演进动力的概念.从实证的角度,国家战略之间互动形成的合力直接促成了国际法包括其法律理念、基本原则、国际强行法和国际组织的产生和发展,是推动国际法演进的直接动力.同时,国家战略互动形成的合力在特定时期是相对稳定的,因而建构在国家战略互动基础上的国际法的演进就是相对明确的和可预见的,由此可以在一定程度上避免国际法的随机性和不可预知性.

| Abstract: | Interaction of state strategies,from an historical aspect,motivates directly the formation,development,and change of International Law,including its logos,basic principals,jus cogens,and international organizations.As the consequence of the Interaction of State Strategies keep relative stationary during special period,the evolution of International Law grounded in this process would be reasonably determinable and predictive. |
