| 摘 要： | 为了构建人与自然环境的和谐，1997年《刑法》规定了破坏环境资源保护罪。对破坏环境资源保护罪在刑事责任上应采用无过错责任原则，在处罚上扩大罚金刑和非刑罚措施，在司法认定该罪因果关系上应采纳疫学的因果关系。

| Abstract: | To form the harmonious relationship between human and the natural environment, the crime of undermining the protection of environment and resources was added in the Criminal Law in 1997. In this thesis, the author mainly investigates the application of liability without fault principle and causation of epidemic disease in this kind of crime. |
