论合理性司法建构的前提

在“法治”的实施过程中，司法的功能日益引起了人们的重视。由于受历史和现实因素的影响，我国的司法存在着一些抑制其功能发挥的缺陷，现行的司法难以适应法治建设的需要。因此，建构合理性的司法已刻不容缓。从分析我国现行司法的主要缺陷入手，分别从司法独立、司法程序、司法文化三个方面尝试提出建构我国合理性司法的前提条件。

Briefly Talking about the Preconditions Structuring the Rational Judicature

People have increasingly attached great importance to judicial function in the process of rule by law. Because of the influence of the historical and realistic factors, there have been a lot of defects that hamper the exertion of judicial function. The present judicature do not adapt to the demand of rule by law. It is the high time to structure the rational judicature. With the analysis of the primary defects of the present judicature, this article intends to raise some preconditions to structure the rational judicature from the aspects of judicial independence, judicial procedure and judicial culture.
