| 摘 要： | 行为人只有在认识到自己的行为会发生危害社会的结果时,才能构成故意犯罪,但理论和实务上对认识因素的内容理解不甚一致,本文认为,犯罪故意中除包含危害行为、危害结果、犯罪对象等内容外,还应包括对因果关系、社会危害性和违法性的认识等内容。

| Abstract: | It can be called as 'calculated crime'only if the actioner realizes the offenses to the society of his\her action,while the understanding to its content are not of the same from the point of practice and theory.The thesis believes that the content should include not only offense action,offense result and object of crime,but also the understanding to causality,characteristic of offense to society and illegality. |
