行政精神损害赔偿制度的法律思考

由于行政执法实践中的精神损害赔偿案件的存在和我国目前行政精神损害赔偿机制不完善的现状，使《国家赔偿法》及司法机关在处理此类案件时均处于尴尬境地。因此，应尽快建立和完善我国行政精神损害赔偿制度，保护受害人的合法权益。同时，这也是国际上许多国家和地区行政精神损害立法趋势的必然要求。

Consideration on the Law of Compensation of Administrative Spiritual Tort

According to the state compensation law, the state will not compensate for the spiritual torts caused by administrative organ and its public servants. This rule is not fair to some victims. So the author suggests that the state should be responsible for the spiritual torts .It intensifies the sense of responsibilities of the national compensative obligations to complete the compensative mechanism of the administration tortuous spirit. It is the inevitable require of the tendency of administration spirit damaging methods of many countries and districts in the world.
