| 摘 要： | 本文通过对网络犯罪的形态、特点以及构成特征的阐述和分析展示出了网络犯罪的巨大危害性.同时,通过对目前打击网络犯罪所面临的问题的思考,剖析了我国刑法对网络犯罪的法律适用问题.
