集体跳槽及其法律规制

摘    要:集体跳槽是当今经济生活中较为常见的现象,也由此产生了很多问题,作者对集体跳槽的原因进行了分析,指出集体跳槽有两种表现形式,一是伴随着对原企业商业秘密的侵犯。一是竞争企业专门打击对手的手段。笔者认为两种情况都构成不正当竞争。并根据各国相关的立法规定,提出了如何规范集体跳槽的几点建议。

Abstract:Collective abandoning the job in favor of another is a common phenomenon in modem economy and it has caused a lot of problems. The author analyzes the cause of it and points out the two ways of it: one is to destroy the business secret of the former enterprise, the other is the method of the competitive enterprise to deal with its rival. The author thinks they all function as an unfair competition, and gives some advice on how to deal with it according to different countries' laws.
