| 摘 要： | 生物技术的发展为人类解决疾病防治、人口膨胀、食物短缺、能源匮乏、环境污染等一系列问题带来了希望。但同时在科学研究、开发、生产和运用中造成对人类健康、生态、伦理、法律等的有害影响。尤以克隆技术对我国现有的民法和刑法带来巨大的挑战;基因技术的发展和应用有可能危及到对人的本质以及与其相关的人道、人性等问题的重新认识,还会引发基因的隐私权、知情权及基因歧视等法律问题,在基因专利保护方面目前法律也存在空白。本文就此方面的问题进行了论述。

Legal Issues Faced with Biotechnology Development |

| Abstract: | The development of biotechnology brings about new hopes to disease prevention,control of population growth,food shortages,energy shortages and environmental pollution,etc.However,scientific research,development and production application of biotechnology also bring harmful effects in human health,ecological,ethical and legal aspects.Cloning technology challenges our existing civil and criminal laws;the development and application of genetic technology are likely to threat people's understanding of human nature and humanitarian,thus leading to legal issues such as right of privacy,right to know and genetic discrimination.Genetic patent also lacks legal protection in current laws.This paper discusses the ethical and legal issues faced with biotechnology development. |
