| 摘 要： | 数个债权人同时或不同时以其债权向法院申请强制执行,而各债权人的权利请求无法同时获得满足,从而出现执行竞合问题.由于现有立法对该问题的解决缺乏明确的规定,司法实践中较为混乱.本文拟从执行竞合构成条件、竞合形态以及解决方法等角度提出若干设想.

| Abstract: | Several creditors apply for the court's enforcement at the same or not the same time, but all the creditors' request of rights can't be satisfied simultaneously. In this condition, the problem of concurrent execution emerges. Because of the deficiency of explicit regulations, the judicial practice in this area confuses. The article intends to propose several propositions in three aspects: components of concurrent execution, concurrent forms and process of solution. |
