| 摘 要： | 容隐制度是人类社会一项重要的法律制度,它规定一定范围的亲属可以相互隐匿犯罪而不受处罚。无论过去还是现在,大陆法系、英美法系和社会主义法系都有容隐制度的相关规定。中国历史上存在大量、系统的容隐制度,然而,新中国建立后我们抛弃了它。重新确立容隐制度,符合刑法上的期待可能性理论,顺应对人权保护的要求,符合法治精神,符合系统论的观点,符合对更高价值的选择要求,符合犯罪构成理论和证据证明力理论。

| Abstract: | The system of refusing to testify against family member is an important legal system in human society and there have been related regulations in continental law system,English-American law system and socialist law system in the past and present time.It existed numerously and systematically in China's history and was done away with after New China was founded.About the reestablishment of this system in the law,this paper expresses some positive reflections. |
