| 摘 要： | 自愿原则的精神所在———意思自治是民事行为的发生根据;鼓励交易的思想是确定债的效力的指导原则,也值得确定民事行为效力时参考;民事责任的承担应体现最大限度地保护权利人利益的价值取向,体现市场经济以权利为中心的特点。

| Abstract: | The spirit in the voluntary principle- independent initiative is the basis of creation of civil legal affairs. The intention to encourage the trade is the guiding principle for ascertaining the effect of obligation. What's more , it is helpful to determine the effect of civil legal affairs. It should reflect the value of protecting the benefit of the obligees in bearing the civil responsibilities and should embody the character of market-directed economy based on rights as the center. |
