| 摘 要： | 自然人遭受侵害死亡后,最终享有并行使赔偿请求权的只能是死者的近亲属。一方面,近亲属要求获取精神损害赔偿、丧葬费、医疗救治等费用以保护自己的权利;另一方面基于死者对自己生命尊严所享有的权利,近亲属通过继承获得死亡请求赔偿权及相应的赔偿。

| Abstract: | After the death of a natural person being infringed,the ultimate enjoyment and exercise of the right to claim for compensation can only be a close relative of the deceased.On the one hand,the spirit of close relatives,demands for damages,funeral expenses,medical treatment and other expenses in order to protect their rights;the other hand,based on the dignity of the deceased on their own the rights to life,death of close relatives to seek compensation through the succession to the right and the corresponding compensation. |
