警察涉黑犯罪防控机制研究

警察涉黑犯罪作为一种特殊的犯罪形态，是经济社会转型期警察权力异化的集中体现，其社会危害性十分严重。警察涉黑犯罪防控机制是政治法律中的一种运行机制，其目的在于通过有效的预防和控制，确保警察和警察系统不受涉黑因子的影响而使其权力的使用向良性化发展。警察涉黑犯罪，既有外部体制的原因，也有警察个体内部的原因。构建警察涉黑犯罪防控机制，要坚持强调内外结合的监督制约理念，在具体措施上应健全监督、制约警察的内部防控机制；建立公民参与公安执法和投诉警察的外部监督机制；强化警察招录、考核和教育培训机制；完善惩处警察涉黑犯罪刑事立法。

Study on the Prevention and Control Mechanism of Police Involving in Gangs Crimes

As a special form of crime, the police involving dissimilation in the period of economic and social transition, in gangs crimes is a concentrated expression of police power and its social harmfulness is very serious. The connotation and the reasons of police involving in gangs crimes are analyzed in this paper. And the measures of supervising and restricting police involving in gangs crimes are put forward. The prevention and control mechanism can ensure the police make good use of its rights and power and make the police power goes in right direction. The police gang-related crime has both the external and internal reasons. The construct of prevention and control mechanism should emphasize the combination of inside and outside supervision, improve the supervision on specific measures, establish the citizen participation in public security law enforcement and strengthen the police enroll examination and education training.
