| 摘 要： | <春秋>决狱是中国古代的一项重要司法制度,是一种有重要影响的断案方式.它针对疑难案件适用独特的指导思想"原心论罪",强调主观主义与客观主义相统一的司法审判方式,一定程度上实现了司法公平和正义.

| Abstract: | As an important judicial system in ancient China,"adjudication in accordance with Chunqiu(The Spring and Autumn Annals)" is an influential pattern of settling lawsuit.In order to settle difficult cases,a guidance principle,namely "adjudging an innocent person according to his criminal intent",has been put forward in "adjudication in accordance with Chunqiu",which emphasizes the combination of subjectivity and objectivity in the trial,and it realizes the judicial fairness and justice to a certain extent. |
