试论严格责任的引进与否

实现国际接轨以来，我国立法也在不断吸收借鉴外国法律的相关规定。但在侵权责任归责原则这一领域中，关于是否应该适用严格责任，以及是否可以用严格责任来替代无过错责任的争议日益激烈，而学者们对侵权责任法归责原则的态度，决定了未来侵权责任法的发展方向。

On the field of tort liability principles, the dispute whether the strict liability should be applied andwhether the strict liability could be replaced by the noffault liability has been argued more and more fiercelyl however, the scholars attitude to-wards this will determine the development of it in the future. Hence, it is essential for us to comprehend the strict liability well.
