关于反垄断法域外效力的几点思考

随着国际经济交往的日益频繁，发生在一国境外的反竞争行为会在国内产生垄断后果，影响国内经济的健康发展。因此，许多国家规定了本国反垄断法的域外效力，其中以美国和欧盟的规定最为典型。研究美国和欧盟等国家反垄断法的域外效力并理清其中有争议的理论对于我国加入世贸之后的法律重构无疑具有重要的现实意义。

Reflections on Extraterritorial Effect of Antimonopoly Law

With the gradual prosperity of international economical exchange, the extraterritorial anti-competition action will produce the consequence of monopoly and will influence the sound economic development. Therefore many countries regulate that the intra-area antimonopoly law has the extraterritorial effect, and among these countries the regulations of the U. S and the Europe Union are very typical. The study of the extraterritorial effect of these rules and clean up the theoretical dispute will be of great current significance for the law reconstruction of our country after the entry of WTO.
