| 摘 要： | 在考察我国现有拘留理论和拘留立法并深入实践调查研究的基础上，对民法通则第134条中规定的拘留的含义，名称，适用价值，适用根据，适用主体，适用程序等进行了基础性的探讨，同时认为这里的拘留是一种不同于其它所有拘留的独立的拘留形式即“民事制裁拘留”。

| Abstract: | To base on observing and studying available theory and legislation about detention in our country, and on investigating and studying deeply practice ,the article probes into and analyzes the meanings,the name,the worth of applying ,the basis of law, the main body of applying.the program of applying and so on about detention in the 134th item of the Civil Law General Principle.In the meanwhile the article is of opinion that this detention is independent form different form all other ones,that is Civil Punishable Detention |
