浅析表演代理的不可行性

身份行为不可代理，这是传统的代理制度的通说观点。然而在演员演出领域，这种事情经常发生，也就是常说的“找替身”。按照代理的理论来说，这显然是不受代理制度规范的。对于这种现象的效力性问题，法律所体现出来的不明确性，是解决这类现象所生纠纷的障碍。本文首先从两大法系关于代理的概念分析人手，界定了何为表演代理。继而从考察代理制度的历史渊源人手，研究了代理制度的目的。最后通过分析表演代理的主体、客体和效力制度，发现了表演代理中存在的矛盾与问题，得出了表演行为不能代理的结论。

Probing the Impossibility of Performing Agency

Capacity-act can not be surrogated, which is the general point of the traditional agency system. But in the performing field, it happens frequently. That is as we know using the substitutionary person. According to the agency theory, the substitute ph- enomenon can not be adjusted by it. The ambiguity of the law on the validity of the agency of performing is the head trouble to solve the dispute which comes from the agency of performing. By analysing the concept of agency,studying the history and the purpose of it,discussing the subject,object and validity of it,the author concluded that performing can not be surrogated.
