由日本核泄漏引发的公民环境安全权思考

肇始于2011年3月11日,由日本地震引发大海啸,并由此造成的福岛核泄漏事故,不仅给日本国民,也给我国境内公民的生命财产造成严重损害或损害威胁。从公民环境安全权入手对核泄漏下的环境安全、环境健康、信息公开等内容进行考究,顺应了理论与实务的需求。公民环境安全权是一种与时俱进的综合性、集合性权利。其产生有着深刻的认识论、经济学和法学基础。公民环境安全权是整体性与个体性的统一,是长远利益与眼前利益的统一,是公民环境安全权益和维护环境安全义务的统一。公民环境安全权与其他公民权利,并行不悖,并与其他法律制度相融合。本次日本核泄漏也在一定程度上拷问了公民环境安全权的实践现状。
