关于农村集体土地征地补偿性质的探讨

农村集体土地征地补偿性质和征地性质是两个既有联系又有区别的概念。征地的性质决定着征地补偿的性质,征地补偿的性质又决定着征地补偿的标准、分配范围、分配方法和比例。征地补偿的性质不明确,在现实中产生了很多问题。在现行的法律体系下,我国的征地补偿具有法定性、非市场性、非完全性、成员共有性、非国家支付性、地域差别性和先付性的特点。

Discussion on the Character of Rural Land Expropriation Compensation

In rural land expropriation , the character of compensation and the character of collective collection are two definitions which are both related and different. The character of land collection decides the character of land expropriation compensation, and the expropriation character decides its stander and distribution range, method and proportion. As the character of the compensation is not clear, it brings about many problems at work. Under the present legal system, land expropriation compensation has some characters, i.e. the characters with legality , non-market orientation , imperfection , communion of members, non-state payment, regional difference and prior payment, etc.
