| 摘 要： | 《专利法》对于专利权的法律保护已经达到了TR IPS协议的要求,但面对现代高新技术的迅猛发展,在某些方面已经难以适应时代需求,因此应进一步拓展专利权的客体范围,充分发挥《专利法》对于技术自主创新的促进作用,推动中国社会经济的快速发展。

| Abstract: | The legal protection of the patent right by the Patent Law has met the requirement of the TRIPS agreement.However,with the rapid development of the advanced high-tech,the Legal Law can not meet the demands of the time in some respects.Therefore,it is necessary to further broaden the object scope of patent law and bring the patent law into full play to facilitate the independent technical innovation and impel the rapid development of the social economy in China. |
