| 摘 要： | 宗族在中国古代社会有着重要的地位,宗族通过习惯法实施族内治理。宗族习惯法所确认的审判制度对于解决族内纠纷、维系宗族团结、保障宗族习惯法的权威具有不可忽视的作用。中国古代社会宗族审判制度包括审理机构、审理程序、处罚方式等方面内容。

| Abstract: | In ancient Chinese society,clan has significant role.Clan rules are used for internal control of the clan.The justice system based upon clan rules cannot be neglected as it is available for solving internal dissension,holding the clan together and ensuring the power of clan rules.Patriarchal justice in ancient Chinese society includes judicial organization,judicial process,modes of punishment. |
