和谐社会环境下恢复性刑事政策的思考

恢复性刑事政策旨在建立一个使犯罪人和受害人进入对话状态的"模式"。这一"模式"把犯罪人和受害人组织到一起,承认错误,分担并理解有害的影响,在补偿方面达成一致,就将来的行为构筑理解。现行的刑事政策应回应和谐社会的要求,将恢复性刑事政策作为建设社会主义和谐社会的概括性刑事政策,充分体现恢复性正义。

Thoughts on Recoverable Criminal Policy under Circumstances of Harmonious Society

The recoverable criminal policy is due to establish a "model" in which the criminal and the victim are in the state of having a conversation. This "model" connects the criminal with the victim, and they acknowledge the mistake, share and recognize the negative influence. In addition, it achieves consistent understanding in compensa-tion and the construction of future behavior. The present criminal policy should respond to the needs of harmoni-ous society, regarding the recoverable criminal policy as the general criminal policy of building the harmonious socialist society and fully presenting the spirit of justice in restitution.
