| 摘 要： | 特许经营,是国际流行的一种商业理念,已有一百多年的发展历史,自20世纪90年代进入我国后发展迅速,但在学术界和立法中都相当滞后,本文基于民法理论对特许经营和特许经营权予以定位和分析,并对特许经营中存在的法律问题进行探讨,最后针对立法现状提出一些构想。

| Abstract: | Franchising is a popular international commerce idea with more than a-hundred-year developing history. Got a rapid development since it began to spread in China in the 1990"s, but it keeps delay relatively in both academic circles and legislation. Basing on civil theory author makes a orientation and analysis on franchising and right to franchising in this article, probes into the legal problems remained among the franchising, finally puts forwards some speculation aiming at the legislation present condition. |
