企事业单位多元化用工的动因、偏差及对策——新劳动合同法背景下构建和谐用工制度的思考

摘    要:随着多元用工形式得到了越来越多单位的青睐,多元用工过程中产生的问题和矛盾也日益凸显出来,单位与多元化员工之间、正式工与多元化用工之间不同程度地存在着一些不和谐的现象.按照新劳动合同法的要求,健全多元化用工制度的基本措施包括:理清多元化用工的目的,根据业务发展的不同人员要求建立分层分类的用工形式,构建整体人力资源制度,建立针对多元化用工人员的长效激励机制,营造和谐、公平的企业文化.

Abstract:With popularity of multiple employment policy in more and more enterprises and institutions,the problems and contradictions thereby are becoming more and more prominent.There are some incongruous elements between enterprises and employees,the regular workers and contracted workers.According to the New Labor Contract Law,to establish comprehensive multiple employment policy should include the followings: to clarify the purposes of multiple employment policy;to regularize the employment form according to the different employees' profession and demands;to construct integrated human resources system;to build a long-term incentive mechanism and to create harmonious and justice corporate culture.
