| 摘 要： | 从社会学的＂危险社会＂见解看,危险犯是刑法对社会保护前置化的产物;从预防理论的角度看,危险犯存在与限缩的必要均为一般预防的要求;从刑事政策论的面向看,危险犯的存在有其合理性但也存在隐忧。危险犯的处罚是当今刑法维持规范目的的体现。

| Abstract: | In this article from the view of ＂dangerous society＂ in sociology,dangerous criminal is the result that criminal law provides pre-protection for society,from the angle of prevention theory the existence and limits of dangerous criminal is the requirements of general prevention,through the criminal policy,the existence of dangerous criminal contains its reasonability but exists concern also.The punishment for dangerous criminal reflects the purpose of maintaining norms in current criminal law. |
