| 摘 要： | 行政自由裁量权的滥用是我国行政法治建设所面临的一个严峻问题。我国目前有关行政自由裁量权控制的研讨也仅仅只限于行政内部监督和事后的司法救济途径,而没有从根源上去探索对行政自由裁量权的控制问题。这样的局面导致了现有的控制措施都不能有效的扼制行政自由裁量权的滥用。因而,从源头——即从立法上加强对行政自由裁量权的控制就成为了必然的选择。

| Abstract: | The abuse in Free administrative judgment has been a critical problem now China faces in the legal system. The research on the administrative free judgment is only limited within the interior supervision and remedy after action, which lead to being unable to control the abuse in the administrative free judgment. Therefore, it is a must choice for us to strengthen the control on the administrative free judgment. |
