| 摘 要： | 作为一个新型的法律部门,经济法对法律实务和法学理论的最大影响莫过于其全新的理论视野和整体主义的辩证法思想。对经济法赖以产生、发展和完善的现实基础和理论依据诸如个人和社会、市民社会和政治国家、市场机制和政府规制、经济民主和经济集中等范畴进行辩证分析,可以对经济法的本质和特征有更深层次的认识和把握。

| Abstract: | With its new theoretical vision and dialectic totalism,the economic law,as a new branch of law,has influenced the law practice and jurisprudence extensively.In order to have a deep understanding of the nature and characteristics of the economic law,the present paper makes a dialectical study of the practical and theoretical foundation of the emergence,development and perfection of the economic law.The issues to be discussed include the relationship between individuals and society,citizen society and political state,market mechanism and government regulation,and economic democracy and economic centralization. |
