| 摘 要： | 一部完善的民法典应当包括精神损害赔偿制度。我国现有立法对精神损害赔偿作了一些规定 ,但存在着明显的缺陷。要建立一部比较完善的民法典 ,必须从实体法和程序法两方面加快对我国精神损害赔偿制度的和立法修订工作。

| Abstract: | A perfect civil code must comprise the indemnity system of spirit injury. Our country's law in effect has comprised it, but it lies obvious flaws. In order to establish a perfect civil code, it's snecessary to improve the legislation and modification work of spirit injury's indemnity system in practical and procedual aspects. |
