| 摘 要： | 我国2 0 0 1年颁布实施的《婚姻法》第四十六条规定:因重婚、有配偶者与他人同居、实施家庭暴力或虐待、遗弃家庭成员而导致离婚的,无过错方有权请求损害赔偿。新《婚姻法》确立的这项制度对保护离婚无过错方的合法权益,建立更为完善的社会主义婚姻家庭关系,起到了积极的作用,但作为一项崭新的法律制度,它尚有其不足和有待完善之处。文章试从离婚损害赔偿制度的含义、构成出发,对其法律意义、法律适用中存在的问题及其完善进行解读和探讨。
