| 摘 要： | 同时履行抗辩权是合同履行制度当中的一项重要制度。我国司法实践中忽了这一规则的运用，使许多正当使同时履行抗辩权的被当作违约对待。在实践中如何正确适用同时履行抗辩权，对于维护交易秩序、保障交易安全，有着重要的意义。

| Abstract: | Coincident performance counterplea is an important rule of fulfillment of contract.Due to neglecting itsapplication during judicial enforcement in our country,many behaviors,which should have belonged to proper ways to use coincident performance counterplea,are regarded as breaches.In practice,It is important to use coincident performance counterplea properly.It has great significance to maintain order of transaction and guarantee security of transaction. |
