对乡镇政府与村民委员会关系的法律思考

通过实地考察和思考，认为乡镇政府对村民委员会的指导属于行政指导行为。为了继续推进村民自治，必须按照宪法中的无授予即无权利原则与行政法中的依法行政原则，科学划分乡镇政府行政权与村民自治权之间的界限;规范乡镇政府的政治行为，乡镇政府应实行“积极行政”与“消极行政”相结合的行政策略;依据权责相一致原则将乡镇政府对村民委员会的指导行为纳入法治轨道。此外，还须强化和完善对乡镇行政的监督制度。

On the Relationship Between Villagers Committee and Town Government in Law

Through on-the-spot investigation and pondering, the authors believe that the township government is the guidance of the villagers committee of administrative guidance. To continue to promote the autonomy of the villagers, in accordance with the Constitution conferred no rights principles is no law and the principles of administrative law, scientifically demarcating the township government of the boundaries between the executive power and autonomy of the villagers, clearly the relationship between the township government and the villagers committee. To regulate the acts of town government, it should introduce administrative strategy of combining ＂positive ＂ and ＂negative＂; putting the government guidance to the village committee under the law supervision in accordance with the consistent principle of responsibilities and rights. Bedsides, we should strengthen and improve the supervisory system for the township.
