| 摘 要： | 从唯物史观出发，社会主义市场经济的特征可以通过“市民社会”来理解。现代法权关系根源于市民社会，对市民社会的解剖是市场经济转变法权观念，构建现代法权制度的理论基础；契约性法权关系的确立实现了现代法权关系的转换，顺应了市场经济运行规则的要求。

| Abstract: | Socialist market economy can be understood by civil society on the basis of historical materialism. Modern right roots in civil society,by whose characteristics the transformation of right in market economy and the foundation of modern right rule can be found their theoretical basis. To adjust the development of market economy,we should build up our relationship of modern right. |
