试析汉代妇女权益的差异性

关于汉代妇女的权益问题,前辈学者已经多有涉及。但是,这些研究往往仅依据妇女群体的某些权益就论断其地位高低,忽视了妇女群体内部权益的差异性。其实,汉代妇女因其阶级、伦理身份的不同,其所拥有的权益也存在着显著的差异,具体表现为:社会上层妇女享有的权益远远多于普通阶层的妇女;家庭中长姊拥有训教幼弟(妹)的特权;正妻与妾室尊卑有别;女儿及儿媳的合法权益受到母权的制约,等等。

As far as rights and interests enjoyed by the Han Dynasty women are concerned,former scholars have already done a lot of researches.However,these researches are usually based on some facets of rights and interests enjoyed by women group without noticing its inherent differences.In fact,since the Han Dynasty women belong to different classic and ethnic dignities,the rights and interests enjoyed by them are also different For example,women of upper strata enjoyed more rights and interests than women of average strata;Elder sisters had the privilege to teach their younger brothers(or sisters);Wives are more respectful than the concubines;The daughters and daughters-in-law's legal rights and interests was restricted by the mother right and so on.
