| 摘 要： | 公共利益从不同的角度可以有不同的界定,但是在本质上公共利益产生于人们的理性选择。因此,我们必须强调以不损害少数人的利益为前提,进而产生公共补偿理论。在我国法律制度的建构上,也必须从实体法和程序法两个方面促成公共利益的有效实现。

| Abstract: | Public interest can be defined from different points of view,but it comes from people's rational choice in nature.Therefore,it should be emphasized that there is a premise which does not damage few others' interests,and then the theory of public compensation comes into being.The public interests should be effectively realized from the establishment of substantive law and procedural law in our country. |
