集体经营性建设用地使用权流转的法律障碍及完善

摘    要:为了落实十八届三中全会的决议精神,消除现行法律的限制性规定对集体经营性建设用地使用权流转形成的障碍,立法机关应当对《土地管理法》、《物权法》等法律中的不合时宜的相关规定予以修改以符合立法政策的需要,完善土地和物权法律制度以及其他配套法规,保障集体经营性建设用地入市流转,切实维护农村经济组织和农民的利益.

Abstract:In order to implement the spirit of The Third Plenary Session of the Eighteenth Central Committee, and get rid of the legal obstacles to the transfer of the use right of collective constructive land, the legislature should a- mend those improper rules in Land Management Law and The Real Right Law to comply with the legislation policy and to improve the legal institution of the land, the real right, and the relative ones, thus to ensure the transfer of the collective constructive land in the market and earnestly protect the rural economic entities and the farmers.
